You honor. I'd like to start this here case with one simple question :

What does a mustache signify?

Answer : Manliness!

Is the Orochimaru we know manly at all? I mean, seriously, what kind of a man would go about *ahem* kidnapping young children, strip them and er ... experiment on them?

Furthermore, the defendent repeatedly dresses up as a woman, even talks like one.

Can such a person be a man at all!?

And if he's not a man, how can he have a mustache?

If Orochimaru wished to be a woman he would choose a female body, not Sasuke's. Besides i don't see you accusing every other Naruto char of being gay, though only few appear with mustaches on screen. And about Orochimaru being a man, i'm pretty sure Anko will give you a positive answer on that ;D

But all this manliness talk can lead us far away from the point, let's keep things simple:is it possible that Orochimaru has ever had a mustache?

Now let's remember the first time we actually meet Orochimaru:

Chunin exam, if i'm right. How does he look? A woman. Don't be quick to triumph, Iki, that's just a disguise. A disguise successful enough to fool everyone, even those who know Orochimaru pretty well(Anko, for instance). Actually he stole that woman's face and used it as his own. Now if he can successfully use a woman's face, he might as well use another man's face. Even with a mustache. Therefore there is a certain possibility that Orochimaru has appeared with a mustache. Unless there is a proof that he never ever did so.

so you ADMIT that my client, orochimaru swapped bodies several times.

Think about it, your honor. The effects of post-body swap.

They may very well cause certain metabolisms of the human body to stop functioning.

That may very well explain why orochimaru is interested in children so much, especially the recent case in child abduction, a certain Sasuke Uchiha.

Why, he may have very well lost the ability to regain facial hair!!!

And also think about this, he could disguise himself as ANY person, even a DIFFERENT guy and no one would have recognized him.

DESPITE that, he CHOSE to dress up as a woman. What kind of a man does this show?

All these facts point toward the conclusion that my client is incapable as well as holds no interest in a mustache.

Anyways, to comment. Orochimaru seems to actually prefer those who are girly men, look at Sasuke and Kimmimaru. Additionally, there seems to be a lot of females that he wants to take their bodies, like Anko and Guren(or whoever that crystal chick is called). Additionally, even when he does have a manly body, he then dresses in weird robes and dresses, plus he uses masks so he can feel more like his usual self: a girl.
